what is the copyright point in such case ?

some time ago I took a HOWTO from the previous maintainer and largely
modify it. it had a special licence I kept.

now I would like to change the licence to a more liberal one (that of the
ldp), but I can't contact the previous maintainer (address dead).

can I change the licence ?
